Established in the year 1970, Government Law College, Kozhikode, is one of the pioneering legal educational institutions in the state of Kerala. The institute is owned and operated by the Government of Kerala and is affiliated with the University of Calicut. It is recognized as a Centre of Excellence by the Kerala Government.

About the Seminar

The decision in Kesavananda Bharati vs. State of Kerala, which completed 50 years in 2023, is a landmark legal milestone in the history of Indian jurisprudence. It is the seminal ruling in which the Supreme Court laid down the "basic structure" doctrine on the limits of Parliament's power to amend the Constitution. This landmark legal battle, which unfolded in the mid-20th century, has left an indelible mark on the understanding of fundamental rights and the delicate balance between the amendment power of the Parliament of India and the supremacy of the Supreme Court of India. The pivotal case set the stage for subsequent legal debates on the scope and limitations of the dynamism and basic structure of the Indian Constitution. Over the course of the seminar, we will dissect the intricate legal arguments, the historical context, and the enduring implications of the Kesavananda Bharati case and the scope and limitations of the basic structure doctrine.

Eligibility

Any interested law student, researchers, legal professionals, or faculty from any institution can submit their paper.

Topics

The topic of the paper should be on the areas of the seminar as provided below:

  • Amendment of the constitution
  • Fundamental rights and its amendments
  • Rule of law
  • Constitutional wisdom, etc.

Submission Guidelines

  • The word limit, excluding footnotes, should not exceed 4000 words.
  • The last date for submission of the full paper is September 14th 2023.
