About CCA

The Centre for Consumer Advocacy was set up in the year 2016 in the month of September, with an aim to research, collaborate and create awareness about consumer rights, consumer grievances, and solutions. In line with this, the CCA has carried out research assignments on various consumer issues, in association with the Mumbai Grahak Panchayat, Consumer Association of India, Consumer Guidance Society of India, etc.

About 2nd National Legal Opinion Drafting Competition

In 2023, the Centre for Consumer Advocacy is celebrating International Consumer Week once again from 10th - 15th March. As part of these celebrations, the CCA is hosting its 2nd edition of National Legal Opinion Drafting Competition. We also have a line-up of some of the most distinguished stalwarts in the field of Consumer Laws to speak throughout the week and impart their expert knowledge to our audience.

The Problem

Mr. Sujal Roy, a senior citizen aged 84 years, the complainant, is a retired Bank Employee presently residing in Mumbai. Mr. Roy intended to purchase a residential flat in Suburbs of Mumbai. He identified a residential flat in Vile Parle (West). The said project was essentially a re-development project which was proposed to be constructed on Al-Vera Co-operative Housing Society (“Society”). The project was undertaken by one Avenue Builders Ltd. (“Avenue”). Mr. Roy was not an existing member of the Society.

Mr. Roy entered into an Agreement for Sale dated 4.1.2020 with the Builder. The consideration of the Flat was determined at Rs. 4.50 Crores, with payments to be made on 50-40-10 basis. Mr. Roy paid Rs. 2.25 Crores upfront and the balance 40% was to be paid on obtaining Occupation Certificate and final 10% on possession of the flat.

In the interim, Avenue could not commence construction citing financial problems and National Lockdown due to Covid-19. Ultimately, Avenue communicated to the society that his company would not be able to complete the project and offered to withdraw from the project.

The Society in an EGM, passed a resolution to appoint Victoria Builders LLP (“Victoria”) to take over the project and an MOU was executed between Victoria and Society assigning rights to the former to complete the redevelopment of the building. Mr. Roy was unaware of these developments.

After making inquiries, Mr. Roy realised that Avenue had applied for insolvency and the company was not capable of repaying its creditors. However, Mr. Roy felt that he can still seek possession of the flat from Victoria.

Mr. Roy has approached you for a legal opinion. Please refer to the provisions of the Consumer Protection Act, 2019; MOFA, 1963 with the relevant case law. The Opinion should address all the steps that Mr. Roy can take to submit his claim, relevant documents to be submitted at the Consumer Forum and other necessary details.

Eligibility

Participation is restricted to students currently pursuing their law degree. Law schools/colleges recognised by the Bar Council of India are eligible to participate in the 2nd National Legal Opinion Drafting Competition, 2023.

Team Composition

The team may comprise of a maximum number of 2 members. A maximum of 3 entries are permitted from each institution.

Format of the submission:

  • The language for the competition will be strictly English.
  • The font used must be Times New Roman, size 12, line spacing 1.5, with one inch margin on each side.
  • The font of footnotes must be Times New Roman, size 10, single line spacing.
  • Page numbers must be given at the bottom of the page.
  • The length of the opinion should not exceed 2500 words.
  • The cover page of the submission should include the name of the
  • Authors, with the Authors’ designation (i.e., year of study) and the name of the Institution.

General Rules

  • The Participants have to send the soft copy of the Legal Opinion in pdf form by 12th March, 2023 by 11:59 PM on centreforconsumeradvocacy@gmail.com.
  • The Subject Line should be: “Submission- Legal Opinion Drafting Competition- (Name of Participant 1)- (Name of Participant 2).”
  • Results will be declared on 15th March, 2023 at the Valedictory Ceremony of the Consumer Week.
  • All participants will receive a participation certificate.
  • Entries sent after the deadline shall be disqualified.
  • Any entry found to be plagiarized will be disqualified.

Judging Criteria

Each Opinion shall be evaluated out of 100 points by an evaluator. The criteria for evaluation are as follows:

  • Knowledge of Law and Facts: 25 Points
  • Proper and Articulate Analysis: 25 Points
  • Extent and Use of Research: 20 Points
  • Clarity and Organization: 20 Points
  • Grammar and Style: 10 Points

Prizes

  • The Best Team: Cash Prize of Rs. 2,000/- and a Certificate on Merit.
  • The Runner-Up Team: Cash Prize of Rs. 1500/- and a Certificate of Merit.
  • The Second Runner-Up Team: Cash Prize of Rs. 1000/- and a Certificate of Merit.
