Faculty of Law, Lisbon University is hosting the 5th International Mediation Competition - MediateWise, which aims to provide a unique opportunity for university students to develop their skills in mediation and advocacy. The event offers a comprehensive training course in mediation during the first two days, followed by the General Rounds from July 26th to 29th, 2023. The competition concludes with the Semi-Final and Final Rounds on July 30th, 2023.

In today's world, mediation of disputes has become an increasingly popular approach to resolving conflicts in an amicable manner. With the recent changes and our continued reliance on online platforms, the competition emphasizes the significance of online advocacy and mediation techniques. Participants will receive guidance from professional mediators following the CEDR Model Mediation Procedure (2020).

We believe that this event presents an excellent opportunity for students to enhance their skills, gain valuable experience in mediation and advocacy, and expand their network by connecting with fellow professionals and mediators. Moreover, it is an occasion for colleagues to strengthen their online mediation skills and exchange insights with industry experts.

Aim of the Competition

The aim of the Mediate Wise Competition is for students to learn and develop skills in a realistic situation, acting as both counsel and as mediator. Problems are based on cases where the Convention on International Sale of Goods applies.

Method

Each school’s team consists of three participants and a coach. All members of the team must be enrolled in a programme of tertiary legal studies and none may be licensed to practice law in any jurisdiction. The competition consists of four “tiers”; a training course, the counsel competition and the mediator competition. Each team participates in all tiers, and competes for both awards, one as Best Student Mediation Counsel Team and one as Best Student Mediator. Students take turns being evaluated and playing the roles of the disputing parties

Hybrid Mode (in-person and online participation) with two days of training and five days of competition

Method

Each school’s team consists of three participants and a coach. The competition consists of four “tiers”; a training course, the counsel competition, and the mediator competition.

Each team participates in all tiers, and competes for both awards, one as Best Student Mediation Counsel Team and one as Best Student Mediator. Students take turns being evaluated and playing the roles of the disputing parties.

Programme

I. First Tier [Mediation Training Course]

Training provides basic knowledge and techniques to those who do not study meditation at their university. This levels the playing field, and serves as a review for those who already have a basic knowledge. At the end of the training the teams designate and announce which of their members will compete as mediator and which two will compete as their counsel team.

II. Second Tier [Best Student Mediation Counsel Team]

Two professional Mediators will assess the teams, acting as Independent Evaluators. They will give points for the student’s performance as counsel. Students not competing as counsel play the roles of the parties.

Each professional gives scores based on a standard list of skills and techniques provided to them. The two students are marked as a team rather than individually, according to parameters distributed in advance to the Mediator and Independent Evaluator.

III. Third Tier [Best Student Mediator]

Two professional mediators evaluate the third team member, the student mediator, on areas such as opening statements, time management, how joint sessions are handled, issue spotting, use of caucus, option generation, dealing with confidential information, skills and techniques, completeness of the process, and personal presentation.

IV. Fourth Tier [Elimination Rounds]

Teams who have progressed to the elimination rounds will compete to win the prize of Best Team Award.
