Offences committed by the electronic media are mentioned under Sections 69 to 78 of the Information Technology Act, 2000. This Act does not provide any procedure for the trial of such offence.

Hence, the offences committed by the electronic media will be tried by the procedure of trial of offences contained under the Criminal Procedure Code, 1973, because sub-Section (2) of Section 4 of Criminal Procedure Code, 1973 provides that all offences under any other law (i.e., other than Indian Penal Code, 1860) shall be investigated, inquired into, tried and otherwise dealt with according to the same provisions (i.e., provisions of Cr.P.C.) but subject to any enactment for the time being in force regulating the manner or place of investigating, inquiring into, trying or otherwise dealing with such offences.

Since Information Technology Act, 2000 does not provide the procedure for trial of offences defined under this Act, therefore, according to sub- Section (2) of section 4 of Criminal Procedure code, 1973 offences committed under the Information Technology Act, 2000 will be tried by the procedure of trial of offences given under the Criminal Procedure Code, 1973.
