The compoundable cases are listed under Section 320 of the Criminal Procedure Code and matters not listed under this are non-compoundable offences.

The offence of voluntarily causing hurt is punishable under section 323 of the Indian Penal Code. As per section 320 (2) of CrPC, the offence of voluntarily causing hurt is compoundable by the person to whom the hurt is caused i.e. B in the present case.

However, B is a minor person and the provision states that when the person who would otherwise be competent to compound an offence under this section is under the age of eighteen years or is an idiot or a lunatic, any person competent to contract on his behalf, may, with the permission of the Court compound such offence. Thus, permission from the court becomes necessary when the aggrieved party is a minor child of 17 years as in the present case.
