There were 173,040 deaths from unintentional injuries in 2019. When a loved one or relative dies in an accident caused by another person’s negligence, this is called wrongful death. Unexpectedly losing a loved one or a relative can be shocking and confusing.

Different types of accidents can result in the wrongful death of someone and, in turn, can cause a wrongful death claim to be filed against the negligent party. Lawyers Bernheim Kelly Battista & Bliss recommend contacting an attorney to help. Contacting a professional and experienced lawyer will give the support needed to get through the case.

But, before contacting a lawyer, we have a list of different types of wrongful deaths to help you know if you can start the claim process.

1) Car Accidents

As of 2019, there were 228,679,719 licensed drivers on the road in the United States. With so many people on the road, there are bound to be a few accidents here and there. And there are reasons why wrongful deaths happen in car accidents. Usually, it is due to another person’s negligence. A few examples that can cause wrongful death in cars are texting while driving, drunk driving, distracted driving (like putting on makeup while driving), and not following the speed limit. All of these things can result in someone’s wrongful death.

2) Pedestrian Accidents

Wrongful deaths can also happen to people walking on the street or riding their bicycles. These wrongful deaths happen because pedestrians do not have any protection against drivers that are disobeying the road rules. Although, the city or county can be responsible for a pedestrian’s wrongful death if they do not provide pedestrian lanes.

3) Medical Malpractice

Wrongful death can occur when a doctor misdiagnoses, fails to make a diagnosis, makes a surgical error, or gives the wrong medication to a patient. The most common causes of wrongful death due to medical malpractice are misdiagnosis or failure to diagnose a patient.

4) Work Accidents

If a worker is employed somewhere that is considered high risk, like a construction job, then there is a higher chance of a work accident happening, which can result in death.

5) Premises Liability Accidents

If someone dies on someone else’s property, a premises liability case can be brought against them. The reason is that it is the homeowners’ or renters’ responsibility to keep their property free of hazards. A wrongful death on someone’s property can occur due to a slip and fall or a dog attack.

6) Defective Products

We have all seen the commercials of companies recalling their products because they cause injury to users and sometimes death. The most common causes of wrongful death with defective products are defective pharmaceuticals, defective vehicles, toxic food, and unsafe products for children.

When a death occurs in someone’s life, it is never easy, but it can ease the pain a bit if their loved ones can get the compensation they deserve.

If you have experienced the death of a loved one due to another person’s negligence, do not hesitate to call a lawyer to see what your options are and how they can help you win your case.
